However, Biden does possess the ability to undo the policies of the current administration that are contributing to the border crisis. Johnson urged the president to take immediate executive action and emphasized that Biden could utilize Presidential Authority to Restrict Entry 212(f), Expedited Removal 235(b)(1), Discretionary Detention Authority 236(a), and Mandatory Detention 236(c) to resolve the crisis.
Johnson elaborated, "As stated in my letter, President Biden can initiate border security measures by discontinuing catch-and-release practices, halting the abuse of parole authority, reviving the Remain in Mexico program, broadening the application of expedited removal authority, and resuming border wall construction." He emphasized that the President must reclaim the nation's sovereignty and put an end to the mass release of illegal aliens by utilizing the expansive legal authority he already possesses.
