Despite providing written transcripts of the interview, Garland’s resistance to sharing audio recordings, which allegedly reveal Biden’s mental lapses, led to a contempt vote in the House. The Department of Justice’s subsequent argument that Garland was shielded from prosecution due to executive privilege further fueled Luna’s determination to explore alternative measures, such as inherent contempt.

Inherent contempt, a rarely used Congressional mechanism dating back to 1957, allows the House Sergeant-at-Arms to detain individuals defying congressional subpoenas.
