The special counsel, Jack Smith, shut down any talk of comparing former President Donald Trump’s slip-ups with classified documents to President Joe Biden’s blunders in a fiery court filing. Smith’s right-hand man, David Harbach, made it crystal clear that the actions of the two presidents were as different as night and day.

In a scorching court filing, Harbach stated that no one has come close to Trump’s “willful and deceitful criminal conduct” and gotten away with it. He also pointed out that Trump’s efforts to obstruct justice and hold on to classified documents were on a whole other level. The evidence, according to Harbach, shows a stark contrast in intent between Trump and Biden.
Smith, for the first time, referred to the conclusions of special counsel Robert Hur in his final report on Trump’s mishandling of documents. Hur didn’t recommend any charges against Biden and blamed it on his “poor memory,” a move that didn’t sit well with Biden’s team. Smith’s team flat out shut down any talk of political bias or collusion with Biden, dismissing it as a “conspiracy theory.”
The court filing went even further to claim that Trump’s actions were totally unprecedented in American history. Smith emphasized that no former official has ever come close to pulling off what Trump did.
Smith has been crystal clear that Trump’s handling of documents is on a whole other level from Biden’s, mainly due to intent and cooperation with investigators. He contends that Trump tried to pull the wool over investigators’ and his own lawyers’ eyes while trying to keep hold of classified documents, even after being told it was a no-go.
As expected, Trump is crying foul, claiming that Smith is teamed up with Biden to take him down. The former president has taken aim at the special counsel countless times in public and on social media.
