In a major legal decision, the Supreme Court has ruled in favor of the National Rifle Association (NRA) in a dispute with former New York State Department of Financial Services Superintendent Maria Vullo over First Amendment rights. The court’s unanimous decision allows the NRA’s case against Vullo to move forward, overturning a previous ruling from the 2nd U.S. Court of Appeals.
The lawsuit was initiated by the NRA in 2018 after Vullo allegedly urged insurance companies not to do business with the organization, claiming that any affiliation with the NRA would harm their reputations. The NRA argued that this behavior constituted unlawful coercion by a government official. The Supreme Court, in a decision authored by liberal Justice Sonia Sotomayor, found the NRA’s claims to be at least “plausible” and deserving of further consideration by a lower court.

Notably, the American Civil Liberties Union (ACLU), an organization typically associated with left-leaning causes, supported the NRA in this case, emphasizing the importance of free speech regardless of the speaker. The court’s decision does not address whether Vullo is protected by limited immunity, a doctrine that shields public officials from liability if they were unaware of the unconstitutionality of their actions at the time.
In response to the ruling, a lawyer for Vullo maintained that she did not violate anyone’s First Amendment rights and vigorously defended her actions. Meanwhile, the importance of the 2024 election was highlighted by a statement from former U.S. national security advisor Lt. Gen. Michael Flynn, who emphasized the critical nature of the upcoming election and the need for public support to resist the influence of powerful interests.
