First son Hunter Biden is back in the headlines, this time seeking to have the charges against him in two court cases dismissed. And why not? It seems to be the trend these days. After all, if former President Donald Trump’s classified documents case can be dismissed because of the unlawful appointment of a special counsel, then why not give Hunter Biden the same treatment?
Judge Aileen Cannon recently ruled that Trump’s case violated the appointments clause of the United States Constitution, as the special counsel, Jack Smith, was not confirmed by the Senate. So, naturally, Hunter Biden’s lawyers argue that the same ruling should apply to his cases. However, there’s a small problem. Unlike Smith, special counsel David Weiss has been confirmed by the Senate as the U.S. Attorney for Delaware. Ouch!
But that hasn’t stopped Hunter Biden from trying. His attorney, Abbe Lowell, has written a motion arguing that the exact same authority was relied upon to appoint the special counsel in both the Trump and Biden matters, so both appointments should be invalid for the same reason. Nice try, Mr. Biden, but it looks like there’s a key difference here – Weiss was confirmed, Smith was not.
Biden is facing charges in two cases – one for federal gun charges and another for allegedly filing false tax returns and tax evasion in California. The federal gun charges stem from his lying on a federal gun purchase form about his drug use and illegally possessing a firearm. And now, he’s hoping that the dismissal of Trump’s case will somehow save him from his own legal troubles.

But let’s not forget that a special counsel was also appointed to investigate President Joe Biden for his own classified documents case, and yet no criminal charges were ever brought against him. Funny how that works, isn’t it? It seems like there’s a different set of rules for the Biden family when it comes to the law.
Hunter Biden’s attorneys argue that he should have the right to dismiss an unauthorized prosecution and that the court should correct any miscarriage of justice. Well, Mr. Biden, perhaps you should have thought about that before allegedly breaking the law. It’s not a fair criticism to say that you should have raised these issues sooner. Sorry, but it’s a little late now.
No matter how hard Hunter Biden tries to avoid the consequences of his actions, it’s clear that the law is catching up to him. The dismissal of Trump’s case may have given him some hope, but the fact remains that his special counsel was confirmed by the Senate, unlike Trump’s. The truth is, the Biden family can’t escape the scrutiny forever. And it’s about time they face the music.
