Judicial tyranny has reared its ugly head again. Yet another Obama-era activist judge is meddling where he doesn’t belong. Judge Brian M. Cogan of the Eastern District of New York has blocked the Trump administration’s rightful attempt to end Temporary Protected Status (TPS) for hundreds of thousands of Haitian nationals. These special protections were originally granted after the earthquake in Haiti back in 2010. That was over ten years ago! Apparently, following the letter of the law and prioritizing American interests isn’t a concept this judge understands.
The Department of Homeland Security, led by Secretary Kristi Noem, had the courage to stand up and say enough is enough. By proposing to end TPS sooner than the Biden administration’s soft deadline, they’re acknowledging the obvious – conditions in Haiti have improved significantly since that tragic earthquake. But instead of letting the administration do its job, Judge Cogan steps in, acting like a monarch in a robe, claiming that Noem’s decision oversteps boundaries and that these Haitians should stay put. Has common sense become illegal?

What’s happening here is judicial activism at its worst. The law is crystal clear. TPS is meant to be temporary and focused on real-time conditions in foreign countries. But Judge Cogan, embracing the leftist tactic of weaponizing the courts, cites the Administrative Procedure Act as if it gives him the right to rewrite a clear-cut immigration policy. Future administrations should heed this warning: activist judges might block anything that restores law and order if it conflicts with their open-borders fantasies.
Americans deserve leadership that puts their needs first. The Trump administration was simply trying to restore sanity to a broken system with a time-limited program. What’s next, judges extending TPS for decades? The left loves to undermine America’s sovereignty by stretching temporary programs into permanency, all while calling conservatives heartless. What about compassion for American citizens who suffer from an overwhelmed system?
It’s time for Congress and brave leaders to push back. Let’s remind these robed rulers what it means to rule in a democratic society accountable to the people. Turn the tide against judicial activism. Unelected judges shouldn’t be determining immigration policy. The American people should. When will enough be enough?
